Terms of Service

Welcome to whatsh.app/ening ("whatsh.app", "we", "us", or "our"). By registering for an API key, accessing our endpoints, or installing the Venue Connection Script, you ("Client", "Licensee", or "User") agree to be bound by these Terms of Service.

1. Service Description & API License

whatsh.app/ening operates an enterprise B2B data intelligence pipeline delivering aggregated, structured, and AI-vetted event, venue, and scheduling metadata via RESTful APIs and real-time webhook feeds. Subject to your compliance with these Terms and payment of applicable tier fees, we grant you a non-exclusive, non-transferable, revocable license to access our APIs and query our database solely for commercial integration into your applications.

2. API Keys & Account Security

You must maintain the strict confidentiality of your API keys (prefixed with wh_live_). You are solely responsible for all API requests executed under your credentials. If you suspect any compromise of your API key, you must immediately notify our support team to revoke and regenerate credentials.

3. Acceptable Use & Fair Quotas

You agree not to:

Bypass, circumvent, or exceed designated rate limits (per-minute or daily quota headers);
Resell, redistribute, or sublicense raw, unmodified bulk database dumps without explicit Enterprise commercial authorization;
Attempt to scrape, reverse-engineer, or decompile our internal API pipeline, scoring algorithms, or infrastructure;
Use our API or event data to conduct harassment, spam, unlawful surveillance, or infringement of intellectual property.

4. Venue Connection Script Protocol

Venues installing the whatshappening.js snippet agree that submitted public Schema.org metadata (event titles, descriptions, times, venues, and ticket URLs) will be processed, normalized, and distributed across the whatsh.app client ecosystem and partner consumer applications. Venues retain ownership of their original trademarks and event content.

5. Data Provenance & Compliance Guarantees

whatsh.app adheres strictly to automated web scraping ethics, honoring source robots.txt crawl-delays, excluding sources with restrictive Terms of Service, and executing automated PII (Personally Identifiable Information) scrubbing algorithms prior to event publication. However, event data is gathered from public sources and venue broadcasts; we do not warrant that external venue details, ticket prices, or artist lineups are immune to sudden cancellation or real-time venue alterations.

6. SLA & Warranty Disclaimer

THE WHATSH.APP API AND ASSOCIATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHATSH.APP EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER STATUTORY, EXPRESS, OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WHATSH.APP, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE API; (B) ANY CONTENT OR DATA OBTAINED FROM THE API; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR DATA. IN NO EVENT SHALL WHATSH.APP'S AGGREGATE LIABILITY EXCEED THE TOTAL FEES PAID BY YOU TO WHATSH.APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Indemnification & Hold Harmless

You agree to defend, indemnify, and hold harmless whatsh.app, its parent entities, subsidiaries, affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, obligations, costs, or debt, and expenses (including but not limited to reasonable attorney's fees) arising from or relating to: (a) your use of and access to the whatsh.app API, data feeds, connection scripts, and services; (b) your violation of any provision of these Terms of Service; (c) your violation of any third-party right, including without limitation any intellectual property, privacy, or proprietary right; (d) any claim that your applications, services, or redistribution of event data caused damage or harm to any third party or consumer; or (e) any negligent acts, willful misconduct, or unauthorized use of your API credentials.
